Welcome to OmniForge.online ("Service"), operated by OmniForge VOF ("Company," "we," "our," or "us"). By accessing or using our cloud automation platform or desktop application, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Definitions

  • Service refers to our AI-powered platform, including the cloud-based automation service ("Cloud Automations") and the locally installed desktop application ("OmniForge Desktop").
  • User refers to any person or entity accessing or using the Service.
  • Subscription refers to the paid or free access to the Service.

2. Eligibility & Account Registration

  • You must be at least 18 years old to use the Service.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information when registering.

3. Subscription & Payment

  • We offer free and paid subscription plans.
  • Fees are billed in advance on a recurring basis unless canceled.
  • Prices are subject to change, with reasonable prior notice.
  • Refunds are only provided as required by law.

4. Acceptable Use Policy

  • You may not use the Service for unlawful or harmful purposes.
  • You may not attempt to disrupt or exploit the AI models unfairly.
  • Unauthorized access, scraping, or reselling is prohibited.

5. OmniForge Desktop

OmniForge Desktop is a locally installed application that processes files, documents, and recordings on your device.

  • Local Data Processing: Documents, recordings, and AI inference are processed locally on your device. OmniForge does not upload, transmit, or store your local files on external servers unless you explicitly use a cloud-connected feature.
  • AI Models: The desktop application may download AI models to run locally on your device. These models are licensed for use within OmniForge Desktop only and may not be extracted, redistributed, or used outside the application.
  • Automatic Updates: The application may periodically check for and download updates. You can disable automatic update checks in the application settings. Updates may include security patches, bug fixes, and new features.
  • Recording & Transcription: The application includes audio recording and transcription capabilities. All recordings and transcriptions are stored locally on your device. You are responsible for complying with applicable laws regarding recording consent in your jurisdiction.
  • Telemetry: If telemetry is offered in your version of the application and you choose to enable it, the app may collect anonymized usage telemetry to improve the product. Telemetry is opt-in and can be disabled at any time in the application settings. No personally identifiable information or file content is included in telemetry data.

6. Data Privacy & Security

  • We process personal data in accordance with our Privacy Policy, including the desktop and cloud sections of that policy, and comply with the EU General Data Protection Regulation (GDPR) and relevant Dutch laws applicable to our operations.
  • OmniForge implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction. These include safeguards for data encryption, access control, and ongoing security monitoring. While we strive to maintain the highest standards of data security, no system can be guaranteed to be entirely risk-free.

7. Intellectual Property

  • We retain all intellectual property rights to the Service and AI models.
  • Users retain ownership of their uploaded content but grant us a license to process it within the Service.

8. Service Availability & Modifications

  • We aim to provide reliable and continuous access to the Service, but availability may occasionally be affected by maintenance, updates, or factors beyond our control.
  • OmniForge reserves the right to modify, suspend, or discontinue features or functionality, with reasonable notice where possible.

9. Termination

  • We may suspend or terminate accounts that violate these Terms.
  • Users may cancel their accounts at any time.
  • Upon termination, access to the Service will be revoked.

10. Disclaimers & Limitation of Liability

  • The Service is provided on an “as is” and “as available” basis, without any express or implied warranties, including but not limited to fitness for a particular purpose, reliability, or availability.
  • To the maximum extent permitted by applicable law, OmniForge shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Service.
  • Users remain responsible for evaluating and verifying any AI-generated outputs before relying on or acting upon them.

11. Governing Law & Dispute Resolution

  • These Terms are governed by EU laws.
  • Disputes shall be resolved through arbitration or in the courts of the Netherlands.
  • These Terms and any related documents are provided in English. Translations may be offered for convenience only. In the event of any difference or inconsistency between the English version and a translated version, the English version shall prevail.

12. Changes to These Terms

  • We may update these Terms, and continued use of the Service constitutes acceptance.
